Right To Compensation

An individual has the right to claim compensation for damage or distress caused to his/her goods or rights by any breach of the data protection law by a data controller or data processor. 

How to exercise this right

This compensation must be claimed from the Public Administration or in the courts of law. 

  • Claim from the Public Administration:

If the law has been breached by a public entity (or private entity that carries out tasks on behalf of a public entity), compensation must be claimed from the Public Administration, in accordance with the legislation regulating public administrations.

  • Claims before judges and ordinary courts:

If the law has been breached by a private entity, compensation must be clamed before the courts of justice.
