Right To Challenge Assessments

Data subjects can challenge administrative actions or private decisions which imply an assessment of their behaviour and which are based solely on an automated processing of their personal data intended to evaluate certain aspects of their personality.

Data subjects can request that the processing of their data not be carried out through exercise of their right to objection.

Exceptions to this right

  • This right may not be exercised if the decision has been adopted within the framework of the execution or implementation of a contract at the request of the data subject. However, data subjects must be given the opportunity to defend their rights or interests and must be informed that decisions will be made about this type of characteristics.
  • The right may not be exercised if the assessment of the personality is authorised in law.
